The deal, without the fine print.

What Winnable does, what it doesn't, how billing works, and what we each promise. If anything here is unclear, ask us — we'd rather explain than hide behind legalese.

The short version

  • Winnable finds and scores contracts and drafts responses. It never guarantees an award and it never sends anything without a human.
  • Free to start with no card. Paid plans are flat monthly prices; cancel anytime; we never take a cut of what you win.
  • You own your content. You're responsible for what you submit to the government.
  • Don't scrape us, spam through us, or misrepresent your business.

01The agreement

These terms are a contract between you (and the company you use Winnable for) and Winnable AI(“Winnable”, “we”). By creating an account, using the public win-fit tool, calling our API, or otherwise using getwinnableai.com, you agree to them. If you are accepting on behalf of a company, you confirm you are allowed to.

Our Privacy Policy explains how we handle data and is part of this agreement.

02Accounts and your team

  • Winnable is a business tool. You must be at least 18 and using it for a business.
  • Keep your sign-in details private. You are responsible for what happens under your account, and you must tell us promptly if you think it has been compromised.
  • The person who creates an organisation is its owner. Owners can invite members, manage billing and API keys, and are responsible for their team’s use of Winnable.
  • Give us accurate information about your company. Scores and drafts are only as good as the profile they are built on.

03What Winnable is — and isn’t

Winnable reads public government contracting data, scores opportunities for how well they fit your company, drafts responses and outreach for your review, suggests teaming partners, and organises your pipeline. We call this opportunity intelligence.

To be clear about what it is not:

  • It is not a guarantee of anything. A high score means an opportunity looks like a strong fit compared with others — not that you will win it, be shortlisted, or even be eligible. We never promise awards.
  • It is not legal, accounting or procurement advice. Set-aside eligibility, size standards, certifications and compliance with solicitation instructions are your responsibility. When in doubt, read the solicitation and ask the contracting officer or a qualified adviser.
  • It is not affiliated with the U.S. government. Winnable is a private company. We are not SAM.gov, and using Winnable does not register you anywhere or submit anything to any agency.
  • It does not send anything without you. Drafts, proposals and introductions go out only when a person on your team decides to send them.

04AI output and your responsibility

Winnable uses AI to score, summarise and write. AI makes mistakes: it can misread a notice, miss a requirement, or state something confidently that is wrong. So:

  • Everything Winnable produces is a draft or a signal for you to check. You are responsible for anything you submit, send or rely on, including its accuracy and its compliance with the solicitation and the law.
  • Always verify deadlines, eligibility and submission instructions against the official notice before acting.
  • Do not represent AI-drafted text as something it is not (for example, as past performance you don’t have or certifications you don’t hold).

05Your content

  • You own what you put in — your profile, Vault documents, drafts and edits — and what Winnable generates for you from it.
  • You give us permission to store, process and display that content solely to provide the service to you (including sending it to the AI providers described in our Privacy Policy). We do not use your private content to train models or to benefit other customers.
  • You promise you have the right to upload what you upload, and that it doesn’t include anything you are barred from sharing — including government information marked restricted or for official use only.
  • You can delete your content at any time; see the Privacy Policy for retention.

06Public data and accuracy

The opportunities, awards and company records in Winnable come from public government sources. We refresh them regularly, but they can be delayed, incomplete or wrong at the source, and we may miss or mis-parse a notice. The service is provided on an “as is” basis with respect to this data. The official notice on the government’s own site always controls.

07Plans, billing and cancellation

Winnable has a free plan and paid monthly plans:

  • Free means free. No credit card is needed to start, and we will never charge you without you choosing a paid plan.
  • Flat price only. We never charge a percentage of any contract you win, and we never will.
  • Monthly, in advance. Paid plans renew automatically each month through Stripe until you cancel. Prices are in U.S. dollars and exclude any applicable taxes.
  • Cancel anytimefrom your billing page. Cancellation takes effect at the end of the current billing period; you keep access until then. We don’t refund partial months unless the law where you live requires it.
  • Usage limits. Each plan includes a monthly allowance of scored opportunities, drafts and similar. If you reach a limit, we will tell you in the app rather than charge you automatically.
  • Price changes.We will give you at least 30 days’ notice by email before any price increase affects you. If you disagree, cancel before it takes effect.
  • If a payment fails we will retry and email you. After repeated failures your organisation drops back to the free plan; your data is not deleted.

08Acceptable use

Please don’t:

  • Scrape, bulk-export or resell Winnable’s data or scores, or use the service to build a competing database.
  • Use Winnable to send unsolicited bulk email or to contact anyone you have no legitimate basis to contact.
  • Misrepresent your company’s size, ownership, certifications or past performance, or use Winnable in a way that breaks procurement rules or the law.
  • Try to get around rate limits, plan limits, access controls, or another organisation’s data isolation.
  • Reverse-engineer the service or use it to train a competing model.
  • Upload malware, or content that is unlawful or that you don’t have rights to.

If you break these rules we may suspend or close your account. If it’s an honest mistake, we will talk to you first.

09Messages sent on your behalf

When you ask Winnable to send a teaming introduction, we send one email in your company’s name to the address you supplied, and we identify Winnable as the sender platform. You confirm you have a legitimate reason to contact that person and that the content is accurate. We honour every opt-out across the service, and we may decline to send anything that looks like spam.

10The public API

  • API keys belong to your organisation and can only reach your organisation’s data. Keep them secret; revoke them if they leak.
  • The API is rate-limited and its endpoints may change. We will document breaking changes and give reasonable notice where we can.
  • The acceptable-use rules above apply to anything built on the API.

11Our intellectual property

Winnable — the software, models, design, and the Winnable name and marks — belongs to us and our licensors. We give you a limited, non-exclusive, non-transferable right to use it under these terms. Feedback you send us may be used to improve the product without obligation to you.

12Ending the relationship

  • You can close your account at any time by cancelling any paid plan and emailing us to delete your organisation.
  • We may suspend or close accounts that break these terms, stop paying for a paid plan (you drop to free, not deleted), or create risk for other customers. We will explain why unless the law prevents it.
  • If we ever shut Winnable down, we will give you at least 30 days’ notice and a way to export your data.

13Disclaimers

WINNABLE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DATA OR AI OUTPUT WILL BE ACCURATE OR COMPLETE, OR THAT USING WINNABLE WILL RESULT IN ANY CONTRACT AWARD, SHORTLISTING OR REVENUE.

14Limits on liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WINNABLE AND ITS PEOPLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CONTRACTS, LOST DATA OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE — EVEN IF WE WERE TOLD IT WAS POSSIBLE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE (OR US$100 IF YOU PAID NOTHING).

Some places don’t allow some of these limits; where that applies, they apply only as far as the law permits.

15Your responsibility for claims

If someone brings a claim against us because of content you uploaded, something you submitted or sent using Winnable, or your breach of these terms or the law, you agree to cover the reasonable costs and damages that result.

16Governing law and disputes

These terms are governed by the laws of the United States and of the state in which Winnable AI is organised, without regard to conflict-of-law rules.

If we have a disagreement, please email us first — most things can be sorted out in a conversation. If that fails, either of us may bring a claim in the courts of the jurisdiction above, and we each agree to those courts’ jurisdiction.

17Changes to these terms

We may update these terms as the product evolves. For anything material, we will email account holders at least 14 days before the change takes effect and update the date at the top. Continuing to use Winnable after that date means you accept the new terms; if you don’t, you can close your account before then.
